VUO HOLIDAY HOMES AGREEMENT

This Agreement is a legally binding agreement made between Vuo Supermarket Pte Ltd trading as Vuo Holiday Houses Labasa (Fiji) who is the owner of Vuo Holiday Homes (“Owner”’/ “Vuo Holiday Homes”) and you the Guest(s) (“Guests”). This Agreement is entered into as of the date when the Guests place their reservation online and the reservation is screened and accepted by Vuo Holiday Homes. An acceptance e-mail to confirm that you have read and understood and agree to this Agreement is required before the reservation is accepted.

1. Reservation

The Vuo Holiday Homes accommodation is only for the use of persons named by the booking Guests. Subletting, subcontracting and assigning is prohibited at all times. Vuo Holiday Homes reserves the right to refuse service to anyone who is occupying the holiday home for inappropriate or unlawful use or perceived inappropriate or unlawful use. Guests must provide personal details for all the persons being accommodated in the holiday home: full name, passport number, date and place of birth, nationality, residential address and contact details. Guests must notify Vuo Holiday Homes of any changes to the number of Guests booked and the names of the Guests who will be occupying the holiday home. This data will be retained for 6 months for the purposes of official enquiry and will thereafter be discarded.

2. Cancellation Policy

Booking fees or deposits are non-refundable. Vuo Holiday Home is not responsible for costs arising from airline changes, the cost of alternate accommodation or cancellation fees arising from this and no refunds/adjustments will be offered. If the holiday home becomes unavailable due to unforeseen circumstances or damage, a refund will be issued however Vuo Holiday Homes is not responsible for any alternative accommodation or flights. This holiday home is to be used by the maximum number of Guests listed in the Schedule to this Agreement only. Guests agree to adhere to the rental policies and rules posted at the holiday home at all times.

3. Check-In/Check-out Time

Check-in time for all holiday homes is 3:00 PM. Check-out time is 10:00 AM or earlier. Exceptions for early check-ins or late check-outs are not possible due to short availability of time to clean the holiday homes.

4. Check-out Procedures

Guests are responsible for the keys and should leave them in the reception. All furniture must be returned to its original location upon Guests’ departure. The holiday home should be left reasonably tidy with any dirty crockery left in the dishwasher (washed) upon departure.

5. Guests’ Responsibilities

It is the Guests’ responsibility to promptly notify Vuo Holiday Homes of any issues or problems encountered during the Guests’ stay immediately when detected. If possible, minor problems may be addressed after Guests’ departure in order to minimise any inconvenience to the Guests.

6. Complaints

We strive to make sure the holiday home is in excellent condition. In the event of a housekeeping or maintenance complaint by a Guest, we will undertake the repair as soon as possible. However, no refund or rate adjustment will be given for unforeseen failures of utilities, internet service or appliances, etc.

7. Deposits/Payments

Half of the total balance must be paid at the time of booking. The final payment must be paid on the day of your arrival along with your acceptance to these terms.

8. Illegal, Hazardous or Prohibited Materials

No illegal, hazardous or prohibited substances are permitted on the property at any time.

9. Errors and Omissions

We strive to ensure that all published information about the property is as complete and accurate as possible. Our website, social media and print media content is reviewed and updated regularly. Vuo Holiday Homes is not responsible for any inadvertent errors.

10. Force Majeure

We accept no responsibility for and shall not be liable in respect of loss or changes caused by Force Majeure, e.g. strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Terrorist Activity, Pandemic or any other event beyond our control and gazetted under the laws of Fiji as a “Force Majeure” event.

11. Lawful Purposes

Guests agree to use the holiday home exclusively for private residence purposes and in compliance with local municipal laws and the prevailing laws of Fiji and for lawful purposes at all times. In the event the holiday home is used at any time for unlawful or improper purposes, Guests will be immediately removed from the property.

12. Liability during Travel

Vuo Holiday Homes assumes no liability for any claims, demands, losses, damages, actions, proceedings, costs (including legal costs and expenses) and liability for any injury, delay or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or person engaged in conveying passengers to or from their holiday home.

13. Liability for Personal Injury and Indemnity

Vuo Holiday Homes shall not be liable for any personal injuries sustained by the Guests, members of Guests’ family or party, employees, agents or visitors regardless how such injuries may occur. The Guest agrees to hold Vuo Holiday Homes harmless from any such personal injury claims, demands, losses, damages, actions, proceedings, costs (including legal costs and expenses) and liabilities at all times. It is the Guest’s responsibility to ensure the safety of other Guests, especially children, when using the holiday homes. Guests will hold the Owner harmless from any and all bodily injury and/or property damage incurred on the property arising out of Guests' negligent acts or omissions. Guests acknowledge that they should always supervise their children and act responsibly. These risks include but are not limited to; the driveway, wet surfaces, balconies/stairs and cleaning supplies used during housekeeping.

Any equipment supplied or rented at the holiday homes should be inspected beforehand by a responsible adult renting the holiday home. The Guests assume all responsibility and risk for the usage of these products. The holiday home has hard floors that may become slippery when wet; it is the Guest’s responsibility to monitor this and avoid any accidents.

14. Maid Service

The holiday homes are cleaned before and after your arrival. Mid-stay maid service is optional for which separate charges will apply.

15. Minimum Stay

A 1- day (check in at 3.00pm and check out at 10.00am next morning) minimum stay is standard.

16. Maximum Occupancy

Maximum occupancy for a holiday home is 2 adults and 2 children (one using the fold-away bed).

17. Personal Effects

Vuo Holiday Homes assumes no responsibility or liability for Guests’ personal effects left behind, forgotten or lost at the holiday homes. We will do our best to search for, retrieve and return any missing items as soon as possible after notification.

18. Pets

Pets are not allowed at any time.

19. Privacy

Where collected, the use, purposes and type/duration of storage will be set out in this Agreement.

20. Holiday Home and Property

Guests will have a set of keys and will be solely responsible for locking of the holiday home and the safekeeping of their personal valuables during their occupancy. Vuo Holiday Homes assumes no responsibility or liability for ensuring that the holiday home is locked and secured during the period of occupation by Guests. In addition, Vuo Holiday Homes shall be held harmless from all claims, losses, expenses or causes of action arising from the rental and occupation of the holiday homes and surrounding property by Guests. Lost keys will incur replacement costs of FJD$50.00.

21. Security Deposit

We take out a pre-authorisation on the bank card used to make the booking of $100.00 one day before arrival. This is removed one day after departure. This is to cover any breakages or other issues caused by the Guests during their stay. Guests are responsible for the cost of replacement of any damage to furniture or to the holiday home and replacement of missing items reasonably attributable to Guests and not returned after notification. Guests will be completely responsible for any and all damages to the holiday home or property caused by themselves, whether accidental or due to Guests’ negligence. The cleaning service performs an inventory/survey of the holiday home and property after Guests depart and notifies Vuo Holiday Homes of any missing items. Vuo Holiday Homes will notify the Guests in the event that items were inadvertently taken and will provide Guests the opportunity to return the missing items or replace the financial value of those items.

22. Service and Repairs

Vuo Holiday Homes reserves the right for our employees, servants and agents to enter the holiday home and property when the property or systems require maintenance and repair. No refunds will be made for minor Guest inconvenience. Vuo Holiday Homes will use every effort to expedite part replacement and schedule repair work to minimise any disruptions caused to the Guests.

23. Service Interruptions

Vuo Holiday Homes cannot guarantee that there will be no interruption of services which we have no control over. These include, but are not limited to: electrical service, internet, telephone, water connections, cable or satellite television. Vuo Holiday Homes will make every effort to escalate and expedite any interrupted service issues so they can be restored as quickly as possible. No refund or rate adjustment will be given for unforeseen failures/interruption of these services.

24. Smoking

Smoking is not permitted in the holiday home at any time. There is a penalty of up to $50.00 (the cost of cleaning the house) for smoking inside.

25. Insurance

We recommend that you purchase travel insurance.

26. Wedding and Other Special Events

Any function to be held at the holiday home or the property such as a dinner party, wedding, reception, etc. will require prior written consent from Vuo Holiday Homes. There is a fee to hold any type of gathering or function at our holiday home beyond the number of people listed on your confirmation. The fee varies for this privilege based on property and number of guests. A refundable event security deposit is also required. Guests will pay any fines or penalties resulting from non-compliance with this requirement.

27. Independent Legal Advice

The Guest confirms that he or she understand the contents of this Agreement, acknowledges being given an opportunity to obtain independent legal advice and has either obtained such legal advice or waived such right.

28. Partial Invalidity / Severance

The illegality, invalidity or unenforceability of any provision of this Agreement under any law or in any circumstances will not affect the legality, validity or enforceability of the provision under another law or in any other circumstances, or the legality, validity or enforceability of any other provision of this Agreement and if by virtue of operation of any law, any clause herein subsequently becomes void, illegal or unenforceable, that clause or provision only will be deemed to be severed from this Agreement without affecting the validity of the remaining provisions of this Agreement.

29. Fiji Law & Jurisdiction

This Lease Agreement will be governed by and construed in accordance with the laws of Fiji and each the Guest irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of the Republic of Fiji.

30. Amendments And Variations

No amendment, waiver or variation of this Lease Agreement will be binding unless set out in writing, expressed to amend, waive or vary this Lease Agreement and signed by or on behalf of both the Lessor and the Lessee.

31. Entire Agreement

This Lease Agreement constitutes the entire agreement between the parties with respect to the subject matter of this Lease Agreement, supersedes all prior discussions, negotiations and other documents related to the agreement contained in this Lease Agreement and its subject matter and will be binding upon and inure to the benefit of their respective successors and, if permitted, assign.
